Aadhaar - India's biggest identity database. 1.3+ billion Indians enrolled. But with great data comes great responsibility and risk!
Aadhaar-related legal issues are rising - privacy violations, data leaks, unauthorized usage, linking disputes. Let's understand your rights and how to protect yourself.
What is Aadhaar?
Aadhaar = 12-digit unique identity number issued by UIDAI (Unique Identification Authority of India)
Purpose:
Unique identity for residents
Eliminate duplicate/fake identities
Efficient delivery of government benefits
Reduce corruption
Biometric-based:
Fingerprints
Iris scan
Photograph
Demographic details
Legal Framework:
Aadhaar Act, 2016:
Governs Aadhaar issuance and usage
UIDAI's powers
Privacy provisions
Penalties for violations
Supreme Court Judgment (2018):
Upheld Aadhaar's constitutional validity
But with limitations on mandatory linking
Protected privacy rights
Major Legal Issues with Aadhaar:
1. Privacy Concerns
Issues:
Massive personal data collection (biometric + demographic)
Centralized database = Single point of failure
Risk of profiling citizens
Surveillance potential
Data sharing with private entities
Supreme Court ruling:
Aadhaar valid but privacy must be protected
Limited mandatory linking
Private companies cannot demand Aadhaar (with some exceptions)
2. Mandatory Linking Controversies
Where Aadhaar IS mandatory (as per Supreme Court 2018):
✓ PAN-Aadhaar linking (for income tax)✓ Government subsidies and benefits✓ Welfare schemes (MGNREGA, PDS, etc.)✓ Government scholarships
Where Aadhaar is NOT mandatory:
❌ Bank accounts (except for government benefit accounts)❌ Mobile SIM cards (SC struck down this requirement)❌ School admissions❌ Private services (e-commerce, Ola, Uber, etc.)❌ Entrance exams (NEET, JEE, etc.)❌ Passports (not mandatory but helpful)❌ Driving license❌ Voter ID❌ Marriage registration
Key point: Private entities generally cannot demand Aadhaar (except specified by law)
3. Data Security and Breaches
Reported incidents:
2018: Alleged data leak of 1.1 billion Indians
Multiple instances of Aadhaar databases found on unprotected servers
Unauthorized access to UIDAI portal
Middlemen selling access to Aadhaar data
UIDAI's response:
Denies major breaches
Says data is secure
Enhanced security measures
Reality:
Some breaches have occurred
Your data may have been exposed
Vigilance needed
4. Identity Theft and Misuse
Common frauds:
A) Aadhaar Number Misuse:
Someone uses your Aadhaar number fraudulently
Opens bank account
Gets SIM card
Takes loans
Commits fraud
B) Authentication Fraud:
Fraudster obtains your biometrics
Uses for unauthorized authentication
Rare but possible
C) Demographic Update Fraud:
Fraudster changes your Aadhaar details
Mobile number, address updated to theirs
You lose access to your own Aadhaar
5. Exclusion from Services
Problem:
Biometric authentication failures (especially for manual laborers - worn fingerprints)
System errors
Genuine people denied services
Can't access rations, pensions
Real impact:
Reports of starvation deaths due to ration denial
Pensioners not getting money
Workers not getting MGNREGA wages
Your Aadhaar Rights:
1. Right to Privacy
Supreme Court (2017) declared: Privacy is fundamental right
Implications for Aadhaar:
Your biometric data is private
Cannot be shared without consent (except as per law)
You can question unauthorized data collection
2. Right to Refuse Aadhaar (In Certain Cases)
Where you CAN refuse:
✓ Private companies (banks, telecom, e-commerce) - They cannot deny service for lack of Aadhaar✓ Schools (government circular says not mandatory)✓ Exams (unless specifically required by law)✓ Non-government services
How to refuse:
"Aadhaar is not mandatory for this service as per Supreme Court judgment"
Quote 2018 SC judgment

Penalty for not linking:
PAN becomes inoperative
Can't file IT return
TDS at higher rate
Penalties
Aadhaar and Children:
Blue Aadhaar (Baal Aadhaar):

Aadhaar Data - What UIDAI Collects:
Core biometric data:
10 fingerprints
2 iris scans
Photo
Demographic data:
Name
Date of birth
Gender
Address
Mobile (optional)
Email (optional)
What UIDAI does NOT collect:
Caste
Religion
Income
Medical history
Bank details
Criminal record
Data Sharing - Where Does Aadhaar Data Go?
Authentication data:
When you authenticate (at bank, etc.), agency gets "Yes/No" response only
Your biometric data NOT shared
Only confirmation that you are you
But concerns:
Authentication logs maintained
Can reveal your movements/transactions
Potential for profiling
UIDAI says:
Data encrypted
Not shared without consent
Secure storage
Critics say:
Centralized data risky
Government can track citizens
Private entities getting access
Aadhaar Legislation - Key Provisions:
Section 29 - Authentication:
No authentication without consent
Informed consent required
Section 33 - Disclosure:
Data can be disclosed only as per law
Court order required
Section 37 - Penalty on UIDAI:
If UIDAI violates provisions, officers punishable
Section 38-42 - Penalties:
Unauthorized access: 3 years + ₹10,000 fine
Disclosing identity info: 3 years + ₹10,000
Unauthorized use: 3 years + ₹10,000
Section 47 - Requesting agencies' obligations:
Must protect Aadhaar data
Can't publish/display Aadhaar number publicly
Best Practices - Protect Your Aadhaar:
✓ Lock biometrics when not in use✓ Don't share Aadhaar number publicly (social media, websites)✓ Use Virtual ID instead of actual number✓ Use masked Aadhaar (hide first 8 digits) when submitting copies✓ Check authentication history regularly✓ Keep mobile number updated (for OTP)✓ Don't store Aadhaar on cloud or unsecured devices✓ Be cautious of phishing - UIDAI never asks for Aadhaar details via call/email✓ Update only at official centers - Beware of fraud centers✓ File complaint immediately if misused
Masked Aadhaar:
What: Aadhaar copy with first 8 digits masked (xxxx xxxx 1234)
How to get:
Download from UIDAI website
Masked version available
Last 4 digits + photo visible
Sufficient for most purposes
Use masked Aadhaar wherever possible instead of full number!
International Comparison:
Similar systems worldwide:
USA: Social Security Number (SSN) - Similar concerns about misuse
UK: National Insurance Number
China: Resident Identity Card
Estonia: e-Residency (digital identity)
India's Aadhaar unique because:
Biometric-based (not just number)
Largest database in world
Used for widest range of services
Future of Aadhaar:
Planned features:
Face recognition authentication
Voice biometric
More services linked
International usage (for NRIs)
Concerns:
More data = more risk
Need stronger privacy laws
Independent oversight needed
What If You Don't Want Aadhaar?
Can you survive without Aadhaar?
Challenges:
PAN-Aadhaar linking mandatory (so need Aadhaar for income tax)
Government benefits require Aadhaar
Many services ask for it (though not legally mandatory)
Possible but difficult:
Can use alternative documents for most private services
But practically, Aadhaar has become near-essential
Reality: Aadhaar is here to stay. Better to have it and protect it than not have it.
Conclusion:
Aadhaar is a double-edged sword:
Benefits: Simplifies identity, reduces fraud, speeds services
Risks: Privacy concerns, data security, potential misuse
Your responsibility:
Know your rights
Protect your data
Use security features (lock biometrics, Virtual ID)
Complain if misused
Stay vigilant
Aadhaar is your identity - Guard it like your life depends on it, because increasingly, it does!
Check your Aadhaar authentication history today and lock your biometrics!
